1. Agreement and provider
These Terms of Use (“Terms”) govern your use of MaintTag for iPhone and iPad. MaintTag is provided by Alex Omanski. “MaintTag,” “we,” “us,” and “our” refer to Alex Omanski. By downloading or using MaintTag, you agree to these Terms. If you do not agree, do not use the app.
These Terms supplement the applicable App Store terms and Apple’s Standard Licensed Application End User License Agreement. If an applicable App Store term controls a particular issue, that term prevails.
2. What MaintTag does
MaintTag helps you keep equipment details, maintenance schedules, service work, meter readings, costs, photos, QR labels, and reminders. When iCloud is available, the app can use your private CloudKit database to update records across your devices.
3. Safety and professional responsibility
MaintTag is a record and reminder tool, not a safety system. It does not replace manufacturer instructions, preventive-maintenance programs, inspections, lockout/tagout procedures, calibrated instruments, professional judgment, licenses, training, or legal and regulatory requirements.
You are responsible for verifying every due date, meter value, service record, QR match, export, and notification before relying on it. Never delay necessary maintenance because a reminder did not appear or a status appeared current.
4. Eligibility and authority
You must have legal capacity to accept these Terms. If you use MaintTag for an employer, business, or other organization, you represent that you are authorized to accept these Terms for that organization. A parent or guardian must approve use by a minor.
5. License and acceptable use
Subject to these Terms and applicable App Store terms, you receive a limited, nonexclusive, nontransferable, revocable license to use MaintTag on Apple devices that you own or control as permitted by Apple.
You may not:
- Use MaintTag unlawfully, to misrepresent maintenance or inspection records, or to endanger people or property.
- Interfere with the app, StoreKit, iCloud, security controls, purchase checks, or access controls.
- Reverse engineer, redistribute, sell, rent, or sublicense the app except where applicable law expressly permits it.
- Scan, import, or share information that you do not have authority to use.
6. Your records and responsibilities
You retain responsibility for information you enter or attach. You represent that you have the rights and permissions needed to store, process, and share it. Avoid entering unnecessary personal, confidential, export-controlled, or regulated information.
Keep an independent copy of important records before deleting the app, changing devices, fixing a storage problem, or erasing data. The publisher cannot recover records that remain on your device or in your private iCloud storage.
7. Local storage and iCloud
MaintTag saves records on your device and can update them through your private CloudKit database. If iCloud is unavailable, new changes may remain on that device. If neither the iCloud-backed store nor the persistent local store can be opened, the app stops before opening the workspace and refuses new changes rather than replacing your records with temporary storage. iCloud updates may be delayed, interrupted, unavailable, or different across devices.
MaintTag is designed for one user. Private iCloud synchronization updates records only between that user’s devices signed into the same Apple Account. MaintTag does not provide a multi-user workspace or cross-user record sharing.
Apple controls iCloud availability, account access, quotas, and service terms. You are responsible for your Apple Account, device security, available storage, network access, and independent backups.
8. MaintTag Pro
MaintTag offers an optional view-only sample workspace. Creating or changing a real workspace requires an active monthly or annual subscription, or a one-time “Lifetime” purchase. Full access includes all MaintTag equipment, maintenance, reporting, export, backup-restore, and QR tools, plus up to ten attachments per service record.
The app shows product names, localized prices, subscription periods, offers, and eligibility supplied by StoreKit. Eligible customers may receive a one-week free trial with the monthly subscription or a one-month free trial with the annual subscription. Lifetime has no trial. Trial eligibility is determined by the App Store, and only the offer shown on the App Store purchase sheet sets the terms and price you pay.
If a trial or subscription ends and no other valid purchase exists, the real workspace becomes read-only. Existing records and attachments remain viewable, searchable, filterable, and scannable. Restore purchases, manage an applicable subscription, Export All Data, and Delete All Data remain available. Creating, changing, importing, or restoring records; deleting individual records or attachments; generating Pro reports or formatted CSV exports; and creating QR labels require full access.
Subscriptions
- Monthly and annual subscriptions include ongoing, substantive updates to MaintTag Pro features during the paid subscription term.
- Payment is charged to your Apple Account when the App Store confirms the purchase.
- A subscription renews automatically for the displayed period unless you cancel it through Apple before the renewal is processed.
- Cancellation stops future renewal and generally does not remove access before the end of the paid period, subject to Apple’s rules.
- You can manage or cancel a subscription through your Apple Account. Deleting MaintTag does not cancel a subscription.
Lifetime purchase
The Lifetime product is a one-time MaintTag Pro purchase linked to the Apple Account used to buy it. “Lifetime” means that this purchase has no scheduled subscription end date. It does not promise that the app will operate forever, work with every future operating system, or include future products or services sold separately.
Verification, restore, and refunds
Pro access starts only after StoreKit confirms a valid purchase. A pending, cancelled, refunded, expired, or unconfirmed purchase does not provide access. Use Restore purchases with the Apple Account used to buy MaintTag Pro when needed. Apple handles billing and refund requests under its policies.
9. Changes to features and pricing
We may improve, modify, or discontinue features when reasonably necessary for security, legal compliance, compatibility, or product operation. App Store prices, taxes, currencies, trials, and offers can vary by storefront and are controlled through Apple. Changes to an active subscription are subject to the notice and consent rules applied by Apple and applicable law.
10. Exports, QR labels, and sharing
Exports and QR labels may contain sensitive equipment details, identifiers, costs, notes, or attachments. You are responsible for reviewing accuracy, selecting recipients, securing printed labels, and protecting files after they leave MaintTag. A QR label is an identifier and does not prove ownership, authorization, inspection, or service completion.
A backup restore uses the data in the selected file. Add-missing mode keeps matching current records; replacement mode can update matching records and permanently delete records absent from the backup. You are responsible for checking the preview, keeping an independent current export, and confirming that you are authorized to import the file. Restored changes may propagate through private iCloud and cannot be recalled from another device once synchronized.
11. Privacy
Our Privacy Policy explains how MaintTag handles information. You agree to use the app in a way that respects other people’s privacy and complies with applicable data-protection, employment, and recordkeeping requirements.
12. Third-party services
MaintTag relies on Apple platform services including the App Store, StoreKit, iCloud, CloudKit, notifications, the camera, and the system photo picker. Apple’s availability, policies, and terms apply to those services. We are not responsible for third-party outages or actions beyond our reasonable control.
13. Suspension and termination
You may stop using MaintTag at any time. We may suspend or terminate access to the app where permitted by Apple and applicable law if you materially violate these Terms, interfere with security or purchases, or use the app unlawfully. Sections intended by their nature to survive termination will survive.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAINTTAG IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECORDS, CALCULATIONS, REMINDERS, SYNCHRONIZATION, EXPORTS, OR PURCHASE SERVICES WILL BE ERROR-FREE, COMPLETE, SECURE, OR UNINTERRUPTED.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, EQUIPMENT DAMAGE, PERSONAL INJURY, OR REGULATORY LOSS ARISING FROM OR RELATED TO MAINTTAG, EVEN IF ADVISED OF THE POSSIBILITY.
These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits non-waivable consumer rights.
16. Governing law and disputes
The governing-law and forum provisions in Apple’s Standard Licensed Application End User License Agreement apply to the licensed app, except to the extent applicable law requires otherwise. Nothing in these Terms prevents you from relying on mandatory consumer protections available in your place of residence.
17. Changes to these Terms
We may update these Terms to reflect changes in MaintTag, Apple services, or applicable law. The “Last updated” date will identify the latest version. Material changes should be communicated through the app or another appropriate channel before they take effect. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
