1. Agreement and provider
These Terms of Use (“Terms”) govern your use of MaintTag for iPhone and iPad. MaintTag is provided by Alex Omanski. “MaintTag,” “we,” “us,” and “our” refer to Alex Omanski. By downloading or using MaintTag, you agree to these Terms. If you do not agree, do not use the app.
These Terms supplement the applicable App Store terms and Apple’s Standard Licensed Application End User License Agreement. If an applicable App Store term controls a particular issue, that term prevails.
2. What MaintTag does
MaintTag helps you record equipment information, maintenance schedules, service activity, meter readings, costs, attachments, QR tags, and local reminders. It works locally and can use your private iCloud database when the configured CloudKit container is available.
3. Safety and professional responsibility
MaintTag is a record and reminder tool, not a safety system. It does not replace manufacturer instructions, preventive-maintenance programs, inspections, lockout/tagout procedures, calibrated instruments, professional judgment, licenses, training, or legal and regulatory requirements.
You are responsible for verifying every due date, meter value, service record, QR match, export, and notification before relying on it. Never delay necessary maintenance because a reminder did not appear or a status appeared current.
4. Eligibility and authority
You must have legal capacity to accept these Terms. If you use MaintTag for an employer, business, or other organization, you represent that you are authorized to accept these Terms for that organization. A parent or guardian must approve use by a minor.
5. License and acceptable use
Subject to these Terms and applicable App Store terms, you receive a limited, nonexclusive, nontransferable, revocable license to use MaintTag on Apple devices that you own or control as permitted by Apple.
You may not:
- Use MaintTag unlawfully, to misrepresent maintenance or inspection records, or to endanger people or property.
- Interfere with the app, StoreKit, iCloud, security controls, entitlement checks, or usage limits.
- Reverse engineer, redistribute, sell, rent, or sublicense the app except where applicable law expressly permits it.
- Scan, import, or share information that you do not have authority to use.
6. Your records and responsibilities
You retain responsibility for information you enter or attach. You represent that you have the rights and permissions needed to store, process, and share it. Avoid entering unnecessary personal, confidential, export-controlled, or regulated information.
MaintTag does not provide a hosted account or records-recovery service. Maintain appropriate independent records and export backups before deleting the app, changing devices, troubleshooting storage, or performing destructive actions.
7. Local storage and iCloud
MaintTag attempts to use local persistent storage with private iCloud synchronization. It can fall back to local-only storage when iCloud is unavailable and, if persistent storage cannot be opened, to a clearly labeled temporary session. iCloud synchronization is eventually consistent and is not guaranteed to be immediate, continuous, conflict-free, or available on every device.
Apple controls iCloud availability, account access, quotas, and service terms. You are responsible for your Apple Account, device security, available storage, network access, and independent backups.
8. MaintTag Pro
The free tier currently supports up to three active equipment records and one attachment per service record. MaintTag Pro currently unlocks unlimited active equipment, up to ten attachments per service record, and Pro reporting, export, cost-summary, and QR-label-sheet features.
Available products can include monthly and annual auto-renewable subscriptions and a one-time, non-consumable “Lifetime” purchase. The app displays the localized product name, price, and subscription period supplied by StoreKit. Test prices or descriptions outside StoreKit do not establish the price offered by the App Store.
Subscriptions
- Payment is charged to your Apple Account when the App Store confirms the purchase.
- A subscription renews automatically for the displayed period unless you cancel it through Apple before the renewal is processed.
- Cancellation stops future renewal and generally does not remove access before the end of the paid period, subject to Apple’s rules.
- You can manage or cancel a subscription through your Apple Account. Deleting MaintTag does not cancel a subscription.
Lifetime purchase
The Lifetime product is a non-consumable MaintTag Pro entitlement associated with the purchasing Apple Account. “Lifetime” means the entitlement does not have a scheduled subscription expiration; it does not guarantee perpetual operation, future operating-system compatibility, or inclusion of separately offered future products or services.
Verification, restore, and refunds
Pro access is granted only after StoreKit reports a verified, active transaction. Pending, cancelled, revoked, expired, or unverified transactions do not grant access. Use Restore purchases with the purchasing Apple Account when needed. Apple processes billing and refund requests under its policies.
9. Changes to features and pricing
We may improve, modify, or discontinue features when reasonably necessary for security, legal compliance, compatibility, or product operation. App Store prices, taxes, currencies, trials, and offers can vary by storefront and are controlled through Apple. Changes to an active subscription are subject to the notice and consent rules applied by Apple and applicable law.
10. Exports, QR labels, and sharing
Exports and QR labels may contain sensitive equipment details, identifiers, costs, notes, or attachments. You are responsible for reviewing accuracy, selecting recipients, securing printed labels, and protecting files after they leave MaintTag. A QR label is an identifier and does not prove ownership, authorization, inspection, or service completion.
11. Privacy
Our Privacy Policy explains how MaintTag handles information. You agree to use the app in a way that respects other people’s privacy and complies with applicable data-protection, employment, and recordkeeping requirements.
12. Third-party services
MaintTag relies on Apple platform services including the App Store, StoreKit, iCloud, CloudKit, notifications, the camera, and the system photo picker. Apple’s availability, policies, and terms apply to those services. We are not responsible for third-party outages or actions beyond our reasonable control.
13. Suspension and termination
You may stop using MaintTag at any time. We may suspend or terminate access to the app where permitted by Apple and applicable law if you materially violate these Terms, interfere with security or purchases, or use the app unlawfully. Sections intended by their nature to survive termination will survive.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAINTTAG IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECORDS, CALCULATIONS, REMINDERS, SYNCHRONIZATION, EXPORTS, OR PURCHASE SERVICES WILL BE ERROR-FREE, COMPLETE, SECURE, OR UNINTERRUPTED.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms limits non-waivable consumer rights.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, EQUIPMENT DAMAGE, PERSONAL INJURY, OR REGULATORY LOSS ARISING FROM OR RELATED TO MAINTTAG, EVEN IF ADVISED OF THE POSSIBILITY.
These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits non-waivable consumer rights.
16. Governing law and disputes
The governing-law and forum provisions in Apple’s Standard Licensed Application End User License Agreement apply to the licensed app, except to the extent applicable law requires otherwise. Nothing in these Terms prevents you from relying on mandatory consumer protections available in your place of residence.
17. Changes to these Terms
We may update these Terms to reflect changes in MaintTag, Apple services, or applicable law. The “Last updated” date will identify the latest version. Material changes should be communicated through the app or another appropriate channel before they take effect. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
